1. Acceptance of these terms

These Terms of Use govern your access to and use of Mirame360, a platform for uploading, encoding, hosting, and embedding 360° videos and photos (the "Service"). By creating an account or otherwise using the Service, you agree to be bound by these terms. If you do not agree, do not use the Service.

2. Eligibility and accounts

You must be able to form a binding contract to use Mirame360 and must provide accurate registration information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at the contact address below if you suspect unauthorized use of your account.

3. The Service

Mirame360 is currently offered free of charge. We may introduce paid plans, usage limits, or additional features in the future; where required by law, we will provide notice before changes take effect for existing users. The Service is provided on an "as available" basis and we do not guarantee uninterrupted or error-free operation.

4. Your content

You retain ownership of the videos, photos, and other material you upload ("Your Content"). By uploading Your Content, you grant Mirame360 a worldwide, non-exclusive, royalty-free license to host, store, encode, reformat, and display Your Content solely as necessary to operate and provide the Service, including generating the renditions and embeds you request.

You are solely responsible for Your Content and for having all rights, permissions, and lawful basis necessary to upload and distribute it. You must not upload content that is illegal, infringes third-party intellectual property or privacy rights, or that you do not have the right to share.

5. Embeds and visibility

Mirame360 lets you generate embeddable players for Your Content and control whether an embed is publicly reachable. You are responsible for the visibility settings you choose. A public embed can be viewed by anyone who has or discovers its link, including when placed on third-party websites; disabling public visibility restricts playback to the access controls described in our Privacy Policy.

6. Acceptable use

You agree not to:

• Upload content that is unlawful, fraudulent, defamatory, obscene, or that exploits or endangers minors.
• Upload content that infringes copyright, trademark, privacy, or other rights of any third party.
• Attempt to disrupt, overload, reverse engineer, or gain unauthorized access to the Service or its infrastructure.
• Use the Service to distribute malware, spam, or to scrape or harvest data without authorization.
• Circumvent any access controls, encoding limits, or usage restrictions we put in place.

7. Enforcement and termination

We may review, restrict, disable, or remove any content, and suspend or terminate accounts, at our discretion and without prior notice, including where we believe Your Content or your use of the Service violates these terms, applicable law, or presents a safety or security risk. You may stop using the Service and delete your account at any time through your account controls.

8. Intellectual property

The Service, including its software, player technology, branding, and design, is owned by Mirame360 or its licensors and is protected by intellectual property laws. These terms do not grant you any right to use Mirame360's name, logos, or trademarks without prior written consent.

9. Disclaimers and limitation of liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. To the maximum extent permitted by law, Mirame360 will not be liable for any indirect, incidental, special, or consequential damages, or for loss of data, revenue, or profits, arising from your use of the Service.

10. Changes to these terms

We may update these Terms of Use from time to time. Material changes will be reflected by updating the effective date above, and where required by law we will provide additional notice. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.

11. Governing law

These Terms of Use are governed by the applicable law of the European Union. Where a matter is not covered by EU law, the law of the operator's country of residence within the EU applies. These terms do not limit any statutory rights you may have as a consumer under the mandatory laws of your country of residence.
